2. Description of Service

Sydium is an AI-powered content creation platform that helps creators generate, schedule, and manage content across multiple social media platforms including TikTok, YouTube, Twitter, LinkedIn, and Instagram. The Service includes but is not limited to:

• AI-powered content generation tools
• Content scheduling and calendar management
• Multi-platform publishing capabilities
• Analytics and performance tracking
• Team collaboration features
• Brand Voice AI training to personalize content generation

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate, current, and complete
• Maintain the security of your password and account
• Accept all responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. User Content and Generated Content

Your Content: You retain all rights to the content you input into our Service. By using our Service, you grant us a license to use your content solely to provide and improve our Service.

Generated Content: Content generated by our AI tools is provided to you for your use. You are responsible for reviewing and ensuring that generated content is appropriate, accurate, and complies with all applicable laws and regulations before publishing.

You agree not to use the Service to create or distribute content that:

• Is illegal, harmful, threatening, abusive, or defamatory
• Infringes any intellectual property or other proprietary rights
• Contains malware or any other harmful code
• Violates any applicable laws or regulations
• Impersonates any person or entity

5. AI Training and Brand Voice Content

Brand Voice Feature: Our Service includes a "Brand Voice" feature that allows you to upload documents and connect social media accounts to train AI models to generate content in your unique writing style.

Content Ownership Warranty: By uploading documents or connecting accounts for AI training purposes, you represent and warrant that:

• You own or have obtained all necessary rights, licenses, and permissions to use such content for AI training purposes
• The content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party
• You have the authority to grant us the rights necessary to process and analyze the content for the purpose of creating your Brand Voice profile

Processing and Storage: Content uploaded for AI training is processed to extract writing patterns, tone, and stylistic characteristics. We do not republish or distribute your uploaded training materials. The raw documents may be deleted after processing, retaining only the derived style parameters.

Indemnification: You agree to indemnify and hold harmless Sydium and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your breach of the above warranties, including any third-party claims that the content you uploaded for AI training infringes their intellectual property or other rights.

No Liability for Training Content: Sydium is not responsible for reviewing or verifying the ownership or rights to content you upload for AI training. You assume all responsibility and liability for ensuring you have the proper rights to use such content.

6. User-Uploaded Media Content

Audio and Media Uploads: Our Service allows you to upload audio files and other media to enhance your content, including adding audio tracks to videos.

Rights and Permissions: By uploading any audio, music, or media files to the Service, you represent and warrant that:

• You own or have obtained all necessary rights, licenses, and permissions to use such content
• Your use of the content does not infringe upon any copyrights, trademarks, or other intellectual property rights of any third party
• You have the right to use any music, audio recordings, or sound effects in the manner intended
• If the content is licensed, your license permits the intended use (including commercial use if applicable)

No Review or Verification: Sydium does not review, verify, or screen user-uploaded media for copyright compliance. We act solely as a tool provider and do not claim ownership of any uploaded content.

Indemnification: You agree to indemnify and hold harmless Sydium from any claims, damages, losses, or expenses arising from your use of copyrighted or unlicensed material, including any third-party claims of copyright infringement.

Platform Enforcement: Social media platforms may independently flag, mute, or remove content containing copyrighted material. Sydium is not responsible for any actions taken by third-party platforms regarding content you publish.

7. Subscription and Payment

Free Plan: We offer a free plan with limited features. We reserve the right to modify or discontinue the free plan at any time.

Pro Plan: Paid subscriptions are billed on a recurring basis. You authorize us to charge your payment method for the subscription fee and any applicable taxes.

Cancellation: You may cancel your subscription at any time. Cancellations will take effect at the end of the current billing period. We do not provide refunds for partial billing periods.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Sydium and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• AI-generated content will meet your specific requirements or expectations

IN NO EVENT SHALL CREATORFLOW BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

9. Termination

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

11. Governing Law
